Geographical Indications

Geographical Indications (GIs) are distinctive signs employed to identify goods as originating from a specific geographical territory, region, or locality, where the quality, reputation, or other characteristic of the good is fundamentally linked to its geographical provenance. Essentially, a GI serves as an indicator on products possessing a specific geographical origin and denotes qualities or a reputation attributable to that place of origin. In India, the legal framework governing GIs is established by the Geographical Indications of Goods (Registration & Protection) Act, 1999.

Typically, applications for GI registration may be submitted by any association of persons, producers, organization, or authority constituted by or under any prevailing law, representing the interests of the producers of the goods in question. A registered GI confers protection for a period of ten years, renewable periodically upon payment of requisite fees.

Our attorneys at L.S. Davar possess the requisite expertise and experience to manage all facets of GI practice, encompassing filings, prosecution, and renewals.

Frequently Asked Questions

A Geographical Indication (GI) is a form of intellectual property that identifies a product as originating in a specific region or locality, where its quality, reputation, or other characteristics are inherently linked to its geographic origin. GIs are protected under laws specific to intellectual property rights and are essential in safeguarding the uniqueness of regional products.

Registering a GI provides legal protection against unauthorized use, imitation, or exploitation of the product name by others. It also enhances the product’s market value by establishing its authenticity and quality, often resulting in better consumer trust and the ability to charge premium prices.

Typically, applications are filed by groups of producers, associations, cooperatives, or government bodies representing the product. Individual applicants are generally not eligible; the GI aims to benefit all producers from the designated region who meet the standards.

The duration of GI protection varies by jurisdiction but typically lasts for 10 years with the option for indefinite renewals, provided the product continues to meet the GI criteria. Regular audits or inspections may be required to ensure compliance.
